Property Division by Agreement of the Parties

Property Division at the Equitable Distribution Hearing
If the parties are unable to reach an agreement regarding the distribution of their property and liabilities, the court will identify the property and classify it as "separate", "marital", or "part-marital and part-separate". Once classified, the court will distribute the property after considering the following factors:
- Monetary and non-monetary contributions to the acquisition of property
- Monetary and non-monetary contributions to the well-being of the family
- Duration of the marriage
- Factors and circumstances that lead to the dissolution
- The age and mental condition of each party
- Liabilities
- Additional factors necessary to make a fair and equitable award
