Virginia Separation and Property Settlement Agreements"The majority of family law cases are resolved through a separation or property settlement agreement that is presented to the court for incorporation into an order. Clients that are informed at the beginning of the process of the financial expense and emotional cost associated with months of divisive, protracted litigation are more likely to seek the benefits of a collaborative divorce or make use of the mediation process." - Pamela M. A "Separation Agreement" or "Property Settlement Agreement" is a document drafted by an attorney that reflects the agreements reached by the parties concerning any rights and/or obligations arising from the marital relationship. A separation or property settlement agreement can provide for the distribution of real estate, household furnishings, automobiles, pensions and retirement plans, bank accounts, bonds and securities, businesses and other investment interests, and any other assets and/or liabilities of either or both of the parties.
In addition, a separation or property settlement agreement can reflect the agreements reached by the parties concerning the custody, visitation and child support obligation for a minor child, and any agreements concerning the spousal support obligation of one of the parties.
