Property Division

Dividing property between divorcing spouses is a difficult and often emotional process.

The Code of Virginia classifies property as Separate, Marital or Part Marital and Part Separate. Once classified, factors considered in the division of such property include:

• Monetary and non-monetary contributions to the acquisition of property
• Monetary and non-monetary contributions to the well-being of the family
• Duration of the marriage
• Factors and circumstances that lead to the dissolution
• Age and mental condition of each party
